{"id":2524,"date":"2015-06-16T10:54:36","date_gmt":"2015-06-16T15:54:36","guid":{"rendered":"https:\/\/gbfamilylaw.com\/?p=2524"},"modified":"2023-11-14T11:56:10","modified_gmt":"2023-11-14T16:56:10","slug":"collaborative-divorce-doesnt-promote-divorce","status":"publish","type":"post","link":"https:\/\/gbfamilylaw.com\/blogs\/collaborative-divorce-doesnt-promote-divorce\/","title":{"rendered":"Collaborative Divorce Doesn&#8217;t Promote Divorce"},"content":{"rendered":"\n<p>As a believing Christian I am often confronted with the question, \u201cHow do you do what you do while claiming to be a Christian?\u201d I\u2019ll save the theological response for another time, but my usual answer is this: \u201cHow does a Christian medical examiner do what he or she does?\u201d When a person dies, the medical examiner does a forensic examination and issues a certificate of death. The M.E. didn\u2019t kill the person.<\/p>\n\n\n\n<p>Similarly, in my role as a Christian <a href=\"https:\/\/gbfamilylaw.com\/our-team\/\">divorce attorney<\/a>, I don\u2019t kill marriages. I don\u2019t even promote killing marriages. What I, and many other collaborative divorce attorneys like me, promote is damage control. For, unlike the medical examiner, who can do nothing for the deceased, divorce and family lawyers&nbsp;have a unique opportunity to help the individuals who are expected to survive and thrive after the death of a marriage.<\/p>\n\n\n\n<p>How? Through a less-adversarial approach to resolving family conflict that has come to be known as <a href=\"https:\/\/gbfamilylaw.com\/services\/divorce\/collaborative-divorce\/\">Collaborative Divorce<\/a> or Collaborative Law. The goal of this approach has nothing to do with promoting divorce, but rather is entirely focused on minimizing the devastation that frequently accompanies divorce: Devastation to the children; devastation to the finances; and devastation to the spouses themselves.<\/p>\n\n\n\n<p>Even in the midst of divorce, most spouses genuinely want to do the right thing \u2013 They may just not agree on what the right thing is. Unfortunately, in most cases those individuals are thrust into a legal system that was designed to manufacture winners and losers. Think about it: In a criminal a defendant is \u201cguilty\u201d or \u201cnot guilty.\u201d In a personal injury or products liability case the defendant is \u201cliable\u201d or \u201cnot liable.\u201d In a breach of contract case the defendant \u201cbreached\u201d or did not breach. Well, who wins in a family law case? (Insert punch line here).<\/p>\n\n\n\n<p>The harsh reality for people of faith is that we live in a fallen world and in a fallen world people are going to <a href=\"https:\/\/gbfamilylaw.com\/services\/divorce\/\">divorce<\/a>. We don\u2019t have to like it and we don\u2019t have to promote it. But, shouldn\u2019t we, as believers, do what we can to promote peace, to facilitate resolution, and to help minimize the devastating impact of divorce?<\/p>\n\n\n\n<h3
